Non-refundable tickets, tours, hotels or other reservations should not be purchased until all visas and passports are secured and in your possession. Prior to placing an order, you should ensure that you have reviewed these Terms and Conditions and that they are acceptable to you. By sending your order to Metropolitan Express, you unconditionally accept the below terms and conditions, including but not limited to that Metropolitan Express is not liable for any action or inaction of any government authority and that Metropolitan Express liability is limited strictly as set forth below. Complete Satisfaction Guarantee: METROPOLITAN EXPRESS WILL REFUND ITS SERVICE FEES (NOT GOVERNMENT/CONSULAR FEES) IF THERE IS A MISTAKE MADE ON OUR PART. MAIL TO US A WRITTEN LETTER DETAILING THE SERVICE FAILURE. METROPOLITAN EXPRESS WILL REVIEW YOUR COMPLAINT AND DECIDE WHETHER TO GRANT OR DENY REFUND FOR ALL OF ITS SERVICE FEES (NOT GOVERNMENT/ CONSULAR FEES). METROPOLITAN EXPRESS RESERVES THE RIGHT TO REFUSE REFUND TO ANYONE AND FOR ANY REASON. Please mail all refund requests to: IF REFUND IS APPROVED, PLEASE ALLOW 3-4 WEEKS FOR REFUND. Metropolitan Express acts only as an expediting agent, and only Embassy/consular officials and U.S. Passport Office agents make the final determination when deciding how fast a visa or passport will be issued and for what period of time (validity) visas can be issued. Metropolitan Express is not and shall not be financially nor morally responsible for the actions and inactions of Embassies, Consulates and the U.S. Passport Agency. Consulates and U.S. Passport Services reserve the right to defer or refer a case for further investigation. They reserve the right to suspend the case to ask for additional documents. They reserve the right to refuse a case without revealing any reasons. This does not happen often, but please be aware that delays can occur on occasion. They’re out of our control and Metropolitan Express is not financially nor morally responsible for any delays in your travel in such cases. Processing time for visas and passports quoted by Metropolitan Express are the processing time listed by US passport agency and foreign embassy and consulates on their official website. Base on our experience with foreign embassies and US passport agency in usual circumstances, the listed processing time is reliable in most cases but are not guaranteed. Metropolitan Express is not and shall not be financially nor morally responsible for any delays or refusal in processing passport and visa caused by false, misleading or missing information provided by customers. Metropolitan Express is not and shall not be financially nor morally responsible for any delays in processing passport and visa caused by US passport agency and foreign embassies due to their volume, workload, policy change, system technical issue and the change of address. Metropolitan Express has no control over official requirements of any US passport agency or foreign embassies. Requirements and policies for issuance of travel documents can and do change often. We cannot be held responsible for changes in official requirements whether mandatory or subjective. We will make any and every attempt to notify you of any such changes as they become available. You’re required to prepay for all services. All consular/government fees are non-refundable once service processing has begun. In the case where a visa or passport application has been canceled or rejected, the service fee will be non refundable. In case mistake is made on our part in dates/names, please notify us within 3 business days after receipt of your visa/passport for necessary corrections to be made. If your trip has been postponed or dates are changed, some consulates permit visa correction for a fee. In the unlikely event that Metropolitan Express is at fault for not returning your completed passport or visa to you by your departure date, Metropolitan Express will refund to you the service fee paid to Metropolitan Express unless such delay is caused by you the applicant, or circumstances beyond our control. The client understands that maximum liability is equal to and no more than the total of which the applicant pays to Metropolitan Express. Metropolitan Express makes no other warranties, expressed or implied. Metropolitan Express will not be liable for any indirect, incidental, or consequential damages. Metropolitan Express’ total liability with respect to each passport application shall be limited to the amount of the service fee paid by the applicant. Any action brought in connection with the services provided by Metropolitan Express must occur in the state in which Metropolitan Express at such time, has its principal place of business, and the law of such state shall govern this agreement and the rights and obligations of Metropolitan Express and the applicant. The Full Legal Version: THIS AGREEMENT is between you, the user of Metropolitan Express and its website and its service. NO LIABILITY AND LIABILITY LIMITATIONS METROPOLITAN EXPRESS IN ALL CASES IS STRICTLY LIMITED TO, AND METROPOLITAN EXPRESS IS NOT AND SHALL NOT BE LIABLE BEYOND, THE FOLLOWING, REGARDLESS OF CIRCUMSTANCES: 1. METROPOLITAN EXPRESS LIABILITY FOR ALL LOSS OR DAMAGE FROM ANY CAUSE OR FAULT WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF OR DAMAGE TO A PASSPORT DURING THE COURSE OF VISA/PASSPORT PROCESSING, IS LIMITED TO THE ACTUAL REPLACEMENT COST OF THE PASSPORT OR $170.00, WHICHEVER IS LESS. METROPOLITAN EXPRESS RESERVES THE RIGHT IN ALL INSTANCES TO SUBSTITUTE REPLACEMENT OF THE DOCUMENTS THAT HAD BEEN IN METROPOLITAN EXPRESS CARE AND CONTROL IN LIEU OF PAYMENT. NOTS. NOTSTANDING THE FOREGOING, METROPOLITAN EXPRESS ACCEPTS NO RESPONSIBILITY FOR THE SERVICES OF THE PASSPORT AGENCY OR EMBASSY/CONSULATE IN CONNECTION WITH THE GRANTING OF PASSPORTS OR VISAS, NOR FOR ANY DELAYS, LOSS OF PASSPORTS OR OTHER MATERIALS OCCASIONED BY SUCH SERVICES OR BY ANY DELIVERY SERVICES SUCH AS FEDEX, UPS, OR THE US POSTAL SERVICE. 2. METROPOLITAN EXPRESS WILL NOT BE LIABLE FOR ANY DAMAGES, COSTS AND EXPENSES FROM ANY CAUSE OR FAULT WHATSOEVER, AND INCLUDING BUT NOT LIMITED TO LIABILITY FOR TRAVEL INTERRUPTION, CHANGES IN TRAVEL OR PREVENTION OR LIMITATION OF TRAVEL AND RESULTING COSTS AND EXPENSES, WHETHER SUCH DAMAGES, COSTS OR EXPENSES BE DIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR OTHERWISE, AND INCLUDING BUT NOT LIMITED TO LOSS OF INCOME OR PROFITS, IN EXCESS OF THE METROPOLITAN EXPRESS PROCESSING FEES PAID BY CUSTOMER FOR VISA PROCESSING, REGARDLESS OF CIRCUMSTANCES, WHETHER OR NOT METROPOLITAN EXPRESS HAD KNOWLEDGE THAT SUCH DAMAGES MIGHT BE INCURRED AND WHETHER OR NOT METROPOLITAN EXPRESS MAY BE, OR MAY BE RESPONSIBLE FOR, A CONTRIBUTING CAUSE. 3. METROPOLITAN EXPRESS WILL NOT BE RESPONSIBLE IN ANY RESPECT OR FOR ANY AMOUNT FOR LOSS OR DELAY CAUSED BY EVENTS THAT WE CANNOT OR DO NOT CONTROL, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, WEATHER CONDITIONS, ACTS OF PUBLIC ENEMIES, WAR, STRIKES, CIVIL COMMOTIONS, ACTS OR OMISSIONS OF PUBLIC AUTHORITIES (INCLUDING PASSPORT AND EMBASSY CONSULAR OFFICIALS) OR YOUR FAILURE TO CAREFULLY INSPECT VISA DATES AND TRAVEL DOCUMENTS. 4. METROPOLITAN EXPRESS STRIVES TO PUBLISH THE MOST CURRENT AND COMPLETE VISA/PASSPORT REQUIREMENTS. HOWEVER, REQUIREMENTS FOR VISAS AND PASSPORTS ARE SET BY SOVEREIGN NATIONS AND ARE SUBJECT TO CHANGE WITHOUT NOTICE. IN USING THIS WEBSITE YOU ACKNOWLEDGE THAT THE SERVICE (A.K.A. WHILE METROPOLITAN EXPRESS MAKES ALL REASONABLE EFFORTS TO ENSURE THAT PASSPORT AND VISA SERVICE LISTED ARE HOLD UP TO HIGHEST ETHICAL AND PROFESSIONAL STANDARDS METROPOLITAN EXPRESS SHALL IN NO WAY BE LIABLE TO YOU IN THE EVENT THAT THESE SERVICES ARE NOT SUITABLE FOR YOUR PURPOSE. Requirements and fees related to the processing of passports and visas are subject to change without notice. US Passport Agency, foreign Consulate or embassy or any other government branch will issue your travel documents (e.g. Visa, Passport) according to information provided on your application, documentation, and payment. Government officials may request additional documentation at their discretion. They may also decline issuance of your visa/passport without disclosing the reason for denial as well as refuse to refund any government/consular fees. Metropolitan Express uses commercial cargo services for all its shipping needs, such as FedEx and UPS, unless instructed otherwise and are subject to the conditions set by these companies. Metropolitan Express is not responsible for any damage or loss that occurs while the product is in client’s possession or in transit. Metropolitan Express strongly encourages its clients to use shipping services that provide real-time tracking of packages in transit. Metropolitan Express is not responsible for any failures or mistakes by shipping companies to deliver, deliver on time, track, locate, keep safe, any and all packages. Metropolitan Express cannot and does not warrant any claims or guarantees made by shipping companies as to the quality of service, timely delivery, availability of service, and other claims. However, no embassy fees, courier fees, shipping charges or any portion thereof will be refunded after the documents have been received and the application process has begun. Metropolitan Express shall not accept any liability for losses, additional expenses or any claim whatsoever due to changes in accommodation or other travel services, sickness, weather, strikes or any other cause.
